darkmoon — End User Licence Agreement

Last updated: 18 September 2026

This agreement is between you and Vinicius Oliveira ("we", "us"), the author and copyright holder of darkmoon ("the Software"). It governs your use of the compiled application. Installing or using the Software means you accept it. If you do not accept it, do not install or use the Software.

Plain English is used deliberately throughout. Where a term matters, it is defined where it is used rather than in a glossary.

1. What you may do

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on devices you own or control, for any purpose, including commercial photography and commercial retouching work.

Photographs you edit with the Software are yours. This licence says nothing about them.

2. What you may not do

You may not:

3. Your photographs and your data

The Software runs on your computer. It reads the photographs you point it at, writes the files you ask it to write, and keeps its catalogue, settings and caches on your own disk. We do not receive your photographs, your edits or your catalogue, and we claim no rights in any of them.

One exception, and it is yours to switch on. The Software can send an image to a third-party cloud service — the providers offered in the AI Denoise dialogue — but only when you choose such a provider and supply your own API key for it. When you do, that image and that key leave your computer and go to that provider, and what happens to them there is governed by that provider's terms and privacy policy, not by this agreement. We are not a party to your relationship with them. Every other AI feature in the Software runs entirely on your own machine.

4. The AI models and other third-party components

The Software ships with libraries, data and machine-learning models written by other people. They remain theirs, under their own licences, which this agreement does not alter and cannot override. They are listed with their authors, licences and sources in the Software itself, under About → Third-party licences, and in THIRD_PARTY_LICENSES.md.

Two of those licences place obligations on you, not only on us:

The Stable Diffusion inpainting weights. If you install these optional weights to use Generative fill, you are bound by the CreativeML Open RAIL-M licence they carry, whose full text is reproduced in the Software under About → Third-party licences. That licence forbids using the model to, among other things: break the law or infringe anyone's rights; exploit or harm minors; generate or spread verifiably false information in order to harm others; generate or spread personal identifiable information that could harm someone; defame, disparage or harass others; automate decisions that materially affect someone's legal rights or their access to essential services; discriminate against individuals or groups on the basis of legally protected characteristics; exploit the vulnerabilities of a specific group; or generate or spread content that is used to defame, disparage or otherwise harass individuals. Read Attachment A of that licence in full before using Generative fill. These restrictions bind you as a term of this agreement, and you must pass them on to anyone you let use the Software on your behalf.

Attribution. Several components are licensed CC BY or CC BY-SA and require their authors to be credited. That credit is the Credits screen inside the Software. Do not remove it or prevent it from being shown.

5. Ownership

The Software is licensed to you, not sold. We keep every right in it that this agreement does not expressly grant you. Nothing here transfers ownership of the Software or of any part of it.

6. No warranty

The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will run without interruption or error, that it will suit your purpose, or that any defect will be corrected.

Keep backups of your photographs. The Software writes files and manages a catalogue, and no software is free of defects. Nothing in this agreement makes us responsible for photographs you have not backed up.

Nothing in this section limits any right you have as a consumer under the law of your own country that cannot be limited by contract.

7. Limits on our liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, nor for lost profits, lost work, lost data or lost or damaged photographs, arising out of or connected with the Software, even if we have been told such loss is possible.

Where liability cannot be excluded, it is limited in total to the amount you paid us for the Software in the twelve months before the event that gave rise to it, or, if you paid nothing, to nothing.

Again: nothing here limits liability that the law does not permit us to limit — including liability for death or personal injury caused by negligence, or for fraud.

8. Ending this licence

This licence ends automatically if you break any of its terms. It also ends if you stop using the Software and remove it from your devices. When it ends, you must stop using the Software and delete every copy you hold. Sections 5, 6, 7 and 10 survive.

9. Changes to these terms

We may change this agreement for future versions of the Software. A change does not apply retroactively to a version you already hold: the agreement that shipped with the copy you installed is the one that governs it. Installing a later version means accepting the agreement that comes with that version.

10. Who you bought from

darkmoon is sold through Lemon Squeezy, who act as merchant of record. That means the purchase contract for the subscription is with them, not with us: they take the payment, handle VAT, issue the invoice, and are where a refund or a statutory right of withdrawal is exercised. Their terms and privacy policy cover that side of it.

This agreement is about something else — what you may do with the Software once you have it.

11. Governing law

This agreement is governed by the law of Portugal, where the author is established, and the Portuguese courts have non-exclusive jurisdiction over any dispute arising from it.

If you are a consumer, that choice does not take away the protection of the mandatory rules of the law of the country where you live. Nothing in this agreement affects those rights, and where this agreement and a mandatory rule disagree, the rule wins and the rest of this agreement stands.
